Over the last few years, the EUCCK has raised many issues concerning Korea's lack of IP protection and in a constructive effort we have suggested ways for improvement. Many EUCCK members are still confounded by the huge gap between perception and reality when it comes to Korea's claims to enforce IP protection. Korea has an excellent IPR legal framework which complies with the WTO/TRIPs Agreements. However, the reality is that counterfeit goods have probably never been more readily available to the consumer in Korea. Search engines easily lead to Internet shopping sites carrying illegal fakes or copied goods. According to recent research conducted by the EUCCK IPR Division, an average of 100-150 Korean sites are trading in counterfeit goods at anyone time. What used to be parallel trading of genuine goods, sourced abroad & sold for 20-30% less than the local retail price, has now become almost completely an activity trading in fakes, also cleverly priced at 20-30% less than local retail. The fact that the consumer cannot "touch or feel" the product before purchase makes it easier for the consumer to be duped. The margins for the operators are huge, so more & more criminals want a piece of this trade. These sites offer fake brands of leather goods, drugs, cigarettes and even counterfeit Apple iPods.

CHANEL, EUCCK IPR Committee member takes counterfeiting seriously and has made it a top priority to stop the sale of knock off products. This European company ongoingly monitors the Internet and auction websites and takes action against counterfeiters via legal actions and warnings. |

The Fair Trade Division (FTD) of the Korea Customs Service hosted a joint dialogue on IPR between the Publice-Private Sector at the Seoul Customs Service Headquarters on March 9, 2006.
Jae Ho Park, director of the FTD went over the general IPR protection situation, KCS IPR protection system, IPR protection activities, counterfeit goods enforcement results, overview of the counterfeit goods special investigation division and the 2006 IPR management direction.

International Patent Classification (IPC), the standard of classifying patent technology, has been revised to its 8th edition and became effective on January 1, 2006.

A resident of Gyeonggi Province won KRW 3.3 million (USD 3,397) from the Korean Intellectual Property Office (KIPO) in February 2006, for reporting counterfeit goods. He is the first winner of the anticounterfeiting reward system that was established by KIPO last January. A KIPO officer said that many cases were reported last January, and the number of winners like him is expected to increase.

The survey on national R&D patent technology trend would be expanded to include about 1900 subjects in 8 ministries and offices, increasing from 538 subjects in 4 ministries and offices of the previous year. The expansion of subjects is expected to improve the efficiency of national R&D projects.

The Republic of Korea overtook the Netherlands as the 6th biggest user of the PCT and China dislodged Canada, Italy and Australia to take the position of 10th largest PCT user. The top users of the international patent system remained unchanged, namely: United States of America, Japan, Germany, France and the United Kingdom.
