The EUCCK's Intellectual Property Rights (IPR) Committee organized a luncheon meeting on ¡°Criminal Investigations & Crackdown Operations Against IPR Violations in Korea¡± with Mr. Beom Jung Suh, Director of the Criminal Investigations Bureau of the Supreme Prosecutor's Office (SPO) on May 16, 2006 at the Lotte Hotel in Seoul. The EUCCK and the SPO discussed various issues including: IPR Committee's 2006 trade issues on enforcement, SPO's recent investigations and crackdown operations for IPR protection, and further concerns of the foreign business community on counterfeiting and piracy.

This year, the European Union Chamber of Commerce in Korea's (EUCCK) ¡®Open Door' mission to the European Union (EU) took place at a time when South Korea and the European Union have agreed to hold preliminary talks that could lead to the establishment of a free trade agreement (FTA). This is the second mission organized by the EUCCK to meet with the European Commission (EC) officials in charge of trade for several industrial sectors involving ¡®Intellectual Property Rights', ¡®Automobile', ¡®Cosmetics', ¡®Food &Beverage', ¡®Legal Service', ¡®Asset Management and Financial Services', ¡®Pharmaceuticals' and ¡®North Korea'. Each EUCCK committee chairman, director or manager presented the current barriers that European businesses face in Korea to the European Commission (for their information) when meetings take place with the Korean government to discuss ways to expand cooperation and address regulatory and trade problems.

The IPR Committee is having an exclusive meeting with the European Commission Directorate General for Trade on June 15th at the office of the European Commission Delegation in Seoul.
This upcoming event will be a private meeting between the IPR Committee and the European Commission to discuss the foreign business community's stance on the IPR situation in Korea. The IPR Committee chairmen, legal counsel, staff members and member companies will be joining this event.

Today, Intellectual Property Rights is in danger everwhere in the world, and Japan has joined its fellow advocates-US and EU in protecting and promoting the rights of creative inventions and IPR owners. During the 2nd EBOs Regional Meeting ¡°Against Counterfeiting and Piracy¡± in Seoul last year, Mr. Lauren Dubois, the European Business Community's (EBC) Chairman of the Trademarks & Licenses Committee cited that the Japanese laws and regulations to enhance IPR protection have been established and amended over the years. However, the EBC points out that Japan still have a lot to do in order to provide a sound IPR system. In Japan, foreign business are subject of counterfeiting and piracy and most offences consist in counterfeit items of famous European brands like Louis Vuitton, Cartier, Christian Dior, Chanel, Gucci, Fendi, Rolex, Adidas, Dunhill, and so on. Most of the items are consisted of bags (52%), watches (8%), clothes (10%), jewels, belts, etc. Counterfeits sold as counterfeit goods come from neighboring countries -Korea (60%), Hong Kong (8.4%), and China (22%).

The Korea Customs Service (KCS) held a Government-Private Sector Joint Dialogue on May 17, 2006 at the Seoul Customs to report the outcome of seized counterfeit goods from February to April 2006 during their intensive enforcement operation period. According to the Inviestigation Division of the KCS, approximately 489.5 billion KRW worth of counterfeit goods were seized during the previous 3 months.

The Korea Customs Service (KCS) announced a plan to intensify Customs enforcement on a false representation of the country of origin to ensure legitimate trade and protect consumers from damage caused by violation of rules of origin.

Display design applications are drastically increasing on convergence information products, the main topic of Korean industry these days.
KIPO (Commissioner: JUN, Sang Woo) had approved display design as a design right starting July 1st, 2003, and ever since, the number of applications has increased drastically.

Malaysia and El Salvador became the 131st and 132nd contracting states of the Patent Cooperation Treaty (PCT) when they deposited their instruments of accession at WIPO on May 16, 2006 and May 17, 2006, respectively. The Treaty will enter into force for Malaysia on August 16, 2006, and for El Salvador on August 17, 2006. |

Software piracy rate in Korea amounted to 46 % in 2005. While the overall software piracy rate worldwide remained at 35% last year -- the same as in 2004 -- the piracy rate in 51 of the 97 countries surveyed declined, according to a new study done jointly by the Business Software Alliance (BSA) and market research company IDC.
